HCR Issues Fuel Cost Adjustments for Rent Controlled Units

The New York State Housing and Community Renewal Agency (HCR) has issued new fuel cost adjustment factors for rent controlled apartments for the 2012 calendar year. The findings indicate that all types of heating oil, steam and coal increased in price during the 2011 calendar year while prices decreased for buildings heated with gas or electricity.
*The 2012 data for #4 Oil and #6 Oil were amended on March 15, 2012 due to erroneous pricing data furnished to the Division of Housing and Community Renewal’s (DHCR) Office of Rent Administration (ORA). Property owners have until April 2, 2012 to file fuel cost adjustment forms in order to collect the increases retroactive to January 1, 2012. In addition, owners who use a fuel that has dropped in price must timely file for a reduction in fuel cost adjustments or risk a forfeiture of the entire fuel cost adjustment for a 12 month period.
For the first time this year, HCR is requiring online filing of the 2012 Report, Certification and Notice of Fuel Cost Adjustment Eligibility. Paper applications will not be accepted. To file forms online go to www.nysdhcr.gov/rent.
