DHCR Updates Fact Sheets To Comply With New Rent Laws

 

DHCR has issued new fact sheets to conform to the changes in the rent laws made by the Rent Act of 2011.
Fact Sheets #12, #3 and #5 reflect the changes in the law, effective September 24, 2011, limiting the amount of the permanent rent increase for an individual apartment improvement to only 1/60th of the cost of the improvement in buildings that contain more than 35 apartments and not 1/40th, as was previously allowed for those buildings.

Changes to Fact Sheets #36 and #40 reflect the increase in the high rent vacancy threshold to $2500 and the increase in the high-income high-rent threshold to $200,000.

Changes to Fact Sheets #26, #31, #31a, and #31b were made to conform to the changes made by the 2011 RGB orders in New York City, and Nassau, Westchester and Rockland counties.

The change to Fact Sheet #26 (New York City) also reflects the minimum dollar rent increases authorized by RGB orders #40 and #41 which were upheld in the Casado case in 2011.
